Twist Water Dispenser Terms and Conditions
1. Introduction and Scope
These Terms and Conditions (“Terms”) govern the installation, operation, maintenance, and use of the Twist Water Dispenser (“Device”) provided by Quench USA, Inc. (“Culligan Quench”) to the business customer (“Customer”). These Terms are intended to supplement, and do not replace, the terms and conditions of the Customer’s standard rental agreement with Culligan Quench (“Rental Agreement”). In the event of any conflict between these Terms and the Rental Agreement, the terms of the Rental Agreement shall prevail, except as expressly set forth herein. The Device is intended solely for commercial or business use and is not designed, intended, or warranted for personal, household, or consumer purposes.
2. Device Features and Connectivity
The Device may offer the following features and functionalities:
- Dispensing of cold, ambient, hot, and chilled sparkling water, with customizable temperature and carbonation levels as available.
- A variety of customizable flavor and sweetener options, allowing end users to tailor beverages to their preferences.
- 15.6-inch touchscreen controls for intuitive user interaction, selection of beverage options, and access to Device status information.
- Advanced multi-stage filtration and UV-C LED protection to maintain high water quality and safety standards.
- Remote system monitoring via secure cellular connectivity, enabling Culligan Quench to provide proactive service support, including remote troubleshooting, system updates, and maintenance monitoring.
- Alternative connectivity options via Wi-Fi or Ethernet, which require the Customer to provide and maintain the necessary network credentials (SSID and password) and ensure network compatibility and security.
- The “Drink Capture” feature, which automatically tracks and reports Aggregate Usage Data, such as most used flavors, sweetener usage, and volume dispensed, for operational and service improvement purposes. No personal or business-identifiable data is collected or transmitted by the Device.
3. Data Collection and Privacy
The Device is designed to protect Customer privacy and does not collect, process, or store any personal or business-identifiable data. Only Aggregate Usage Data (e.g., most used flavors, sweetener usage, volume dispensed) is collected by the Device for operational, maintenance, and service improvement purposes. 4. Network Connectivity and Customer Responsibilities
Culligan Quench will provide an installation guide and a support phone number to assist with Device connectivity questions. Customer is solely responsible for connecting the Device to its own network (Wi-Fi or Ethernet) if such connectivity is chosen, including providing all necessary network credentials, ensuring network compatibility, and maintaining network security. Culligan Quench disclaims any liability for network security breaches, hacking, unauthorized access, or any damages resulting from the Device’s connection to the Customer’s network. Customer is strongly encouraged to follow industry best practices for network security, including but not limited to the use of secure passwords, network segmentation, firewalls, and regular security updates. Customer acknowledges and agrees that it is solely responsible for the security and integrity of its own network environment.
5. Service and Support
Culligan Quench provides proactive service support for the Device, including remote troubleshooting, system updates, and maintenance monitoring through Remote Monitoring. Customer acknowledges that service availability may be affected by factors outside of Culligan Quench’s control, including but not limited to network outages, force majeure events, and third-party service interruptions.
6. Software/Firmware Updates and Feature Changes
Culligan Quench reserves the right, at its sole discretion, to update, modify, or upgrade the Device’s software or firmware remotely at any time, with or without prior notice to Customer. Features of the Device may be changed, enhanced, or discontinued at Culligan Quench’s sole discretion. Where practicable, Culligan Quench will provide reasonable advance notice to Customer of material changes to Device features or functionality. Customer acknowledges and agrees that such updates or modifications may be necessary for continued operation, security, or compliance, and that failure to permit or implement such updates may affect Device performance or support eligibility.
7. Limitation of Liability
Culligan Quench shall not be liable for any damages, losses, or claims arising from network connectivity, hacking, unauthorized access, or security breaches related to the Device or Customer’s network.
8. Relationship to Standard Rental Agreement
These Terms are intended to supplement, and not replace, the Rental Agreement between Culligan Quench and Customer. In the event of any conflict between these Terms and the Rental Agreement, the terms of the Rental Agreement shall control, except with respect to matters specifically addressed herein. Any terms not addressed in these Terms are governed by the Rental Agreement.
9. Updates to these Terms
Quench may update these Terms from time to time in its sole discretion. Notice of material changes will be provided to Customer in writing or electronically. Customer’s continued use of the Device following such notice constitutes acceptance of the updated Terms.
